is the government’s power to seize private property for public use. In preparation for the Unit 5 discussion, read about Kelo v. City of New London, 545 U.S. 469 (2005).

Answer the following questions:
Do you agree with the court’s ruling in Kelo?
Do you see the difference between the governments taking property for the public good as opposed to forcing a land sale to allow another private property owner to take the property?
Does such a notion offend the principles of the 5th Amendment?
Do you agree with Justice O’Connor’s comment that “the ruling favors the most powerful and influential in society and leaves small property owners with little recourse.” Why or why not?

Hello Class,
To expand our discussion, I will include additional questions that pertain to our Unit 5 readings. You are not required to participate in the additional questions that I post. However, responses to the additional chapter questions will count towards your required discussion board postings.
The City of Maplewood has proposed extending a public bike and pedestrian greenway through an established neighborhood. The city argues that this will promote public health, reduce traffic congestion, and increase tourism. However, several homeowners object, arguing that their property values will decline, and they will be displaced from homes they have lived in for decades. The city offers fair market compensation for the properties but refuses to consider alternative routes.
Questions:
Does this project serve a clear “public use,” or is it more of a luxury project?
If you were a homeowner in this neighborhood, would you accept the compensation or fight the eminent domain claim?
Should there be a distinction between public necessities (roads, hospitals) and public benefits (parks, greenways)?

I look forward to our discussion.

Hi Class,
Thank you for actively participating in our Unit 4 DB topic. I enjoyed everyone’s comments. You have made it to Unit 5 and are nearly halfway through the term. Congratulations!
In the previous units you learned about the different forms of real property ownership. You have explored issues associated with multiple owners of property and special ownership forms, as well as reviewing and evaluating critical elements to contracts for the purchase and sale of residential and commercial property.
This week, you will learn about restrictions that can be made on a person’s ownership of property. These restrictions come from many different sources:
Zoning regulations – Local governments have the power to manage land use and building codes.
Taxation – Local governments tax property not only for general revenue, but also for shared improvements to the real property.
Easements and Licenses – The enforceable right to use the real property of another for a particular purpose.
Restrictive Covenants – Private restrictions imposed on the use of private property.
Eminent Domain – Governments have the ability to take certain private property for government use with just compensation.
